　　甲乙雙方經(jīng)協(xié)商，于_ 年_月_日訂立本租房合同，并就以下各條款達(dá)成協(xié)議：

　　第一條：租賃范圍及用途

　　第七條：押金

　　1、為保證本租房合同的全面履行，在簽訂本租房合同時(shí)，乙方應(yīng)支付給甲方個(gè)月租金的押金，押金不計(jì)利息，租房合同終止時(shí)，退還乙方。若乙方不履行租房合同，則押金不予返還;若甲方不履行租房合同，則應(yīng)將押金全額返還并賠償乙方壹個(gè)月的租金費(fèi)用作為因租房造成的損失。但因市容整頓和市政動(dòng)遷而無(wú)法續(xù)租的房屋除外，甲方可不作任何損失賠償，此合同即可終止。

　　2、租借期內(nèi)，無(wú)特殊情況，甲乙雙方不得私自隨意加減租金和更改終止合同租借期。

　　3、甲方有權(quán)向乙方查閱支付國(guó)際長(zhǎng)途的費(fèi)用，或乙方使用國(guó)際長(zhǎng)途電話，可由甲方代買"國(guó)際長(zhǎng)途電話使用卡"，費(fèi)用由乙方支付(根據(jù)卡上密碼可在室內(nèi)電話機(jī)上直撥)。甲方有權(quán)向乙方追索。

　　第八條：禁止租賃權(quán)的轉(zhuǎn)讓及轉(zhuǎn)借乙方不得發(fā)生下列行為：

　　1、 租賃權(quán)轉(zhuǎn)讓或用作擔(dān)保。

　　2、 將租賃場(chǎng)所的全部或一部分轉(zhuǎn)借給第三者或讓第三者使用。

　　3、 未經(jīng)甲方同意，在租賃場(chǎng)所內(nèi)與第三者共同使用。

　　第九條：維修保養(yǎng)

　　1、 租賃場(chǎng)所內(nèi)屬于甲方所有的內(nèi)裝修及各種設(shè)備需要維修保養(yǎng)時(shí)，乙方應(yīng)及時(shí)通知甲方或物業(yè)公司，甲方并及時(shí)安排維修保養(yǎng)。重要設(shè)備需要進(jìn)行大修理時(shí)，應(yīng)通知甲方。

　　2、 上述維修保養(yǎng)費(fèi)用由甲方承擔(dān)，但若由于乙方原因造成的修理，則費(fèi)用由乙方承擔(dān)。

　　3、 屬乙方所有的內(nèi)裝修及各種設(shè)備需要保養(yǎng)時(shí)，由乙方自行進(jìn)行并承擔(dān)費(fèi)用。

　　第十條：變更原狀

　　1、 乙方如對(duì)所租的房屋重新裝修或變動(dòng)設(shè)備及結(jié)構(gòu)時(shí)，須事先征得甲方的書(shū)面同意，所有費(fèi)用由乙方承擔(dān)。

　　2、 乙方在實(shí)施上述工程時(shí)，須與甲方及時(shí)聯(lián)系，工程完畢后應(yīng)通知甲方檢查。

　　3、 乙方違反本合同上述規(guī)定的，甲方有權(quán)要求恢復(fù)原狀，賠償損失。

　　第十一條：損害賠償

　　由于乙方及其使用人或有關(guān)人員的故意或重大過(guò)失行為而對(duì)甲方、其他租戶或者第三者造成損害時(shí)，一切賠償均由乙方承擔(dān)。

　　第十二條：甲方免責(zé)：

　　1、 因地震、水災(zāi)、或非甲方故意造成，或非甲方過(guò)失造成的火災(zāi)、盜竊、各種設(shè)備故障而引起的損害，甲方概不負(fù)責(zé)，但甲方有過(guò)錯(cuò)或重大過(guò)失的情況除外。

　　2、 乙方因被其他客戶牽連而蒙受損害時(shí)，甲方概不負(fù)責(zé)。

　　第十三條：乙方責(zé)任

　　1、 必須遵守本大樓的物業(yè)管理制度。

　　2、 必須妥善使用租賃場(chǎng)所及公用部分。

　　3、 不得在大樓內(nèi)發(fā)生下列行為：

　　(1) 將超重、易燃、易爆、易腐蝕等危險(xiǎn)物品帶入樓內(nèi)或?qū)嵤┢渌�有害于大樓安全的行�?

　　(2) 給甲方或其他租戶(業(yè)主)帶來(lái)?yè)p害的行為，以及對(duì)整個(gè)建筑物造成損害的一切行為;

　　(3) 違反社會(huì)治安、國(guó)家安全和違法行為。

　　第十四條：通知義務(wù)

　　1、 甲乙雙方所發(fā)生的通知均采用書(shū)面形式。

　　2、 任一方的'姓名、商號(hào)、地址及總公司所在地、代表者若發(fā)生變更時(shí)，須及時(shí)以書(shū)面形式通知另一方。

　　第十五條：合同終止

　　因自然災(zāi)害及其他不可抗力事件，使大樓的全部或一部分損壞、破損而導(dǎo)致乙方租賃場(chǎng)所不能使用時(shí)，本合同自然終止。

　　第十六條：合同解除

　　乙方如發(fā)生以下行為之一時(shí)，甲方可不通知乙方而解除本租房合同租房合同，如對(duì)甲方造成損失的，乙方還應(yīng)承擔(dān)賠償經(jīng)濟(jì)損失的責(zé)任。

　　1、 租金及其他債務(wù)超過(guò)半個(gè)月以上未付;

　　2、 租賃場(chǎng)所的使用違反本合同第一條規(guī)定的;

　　3、 違反本合同的有關(guān)規(guī)定的;

　　4、 違反本合同第八、第十四條規(guī)定的;

　　5、 給其他租戶(業(yè)主)生活造成嚴(yán)重妨礙，租戶(業(yè)主)反映強(qiáng)烈的;

　　6、 觸犯法律、法規(guī)、被拘留或成為刑事訴訟(公訴)被告的，以及本人死亡或被宣告失蹤等情況發(fā)生的;

　　7、 有明顯失信或欺詐行為的事實(shí)的;

　　8、 甲方出現(xiàn)前述第3、4或第7項(xiàng)行為的，乙方有權(quán)不通知甲方而解除租房合同，如對(duì)乙方造成損失的，甲方還應(yīng)賠償乙方遭受的損失。

　　第十七條：特別說(shuō)明

　　1、 除第十六條和第二十條所述原因外，租賃期內(nèi)，乙方不得解除本租房合同。若遇特殊情況須解除時(shí)，須以書(shū)面形式提前一個(gè)月通知甲方，但不得收回押金。

　　2、 租房合同簽訂后，租賃期開(kāi)始前，由于乙方原因須解除合同時(shí)，乙方須把已繳的押金作為違約金支付給甲方。

　　第十八條：租賃場(chǎng)所的歸還

　　合同終止時(shí)，乙方應(yīng)將租賃場(chǎng)所內(nèi)屬于乙方所有的一切物品，包括內(nèi)裝修各類設(shè)備、材料全部撤除，使租賃場(chǎng)所恢復(fù)原狀，并經(jīng)甲方檢查認(rèn)可后由甲方收回，所需費(fèi)用由乙方承擔(dān)。

　　第十九條：糾紛解決

　　對(duì)本合同的權(quán)力、義務(wù)發(fā)生爭(zhēng)議時(shí)，如調(diào)解不成，可向有關(guān)管轄的房屋所在地的中國(guó)法院提出訴訟。

　　根據(jù)國(guó)家有關(guān)法律、法規(guī)和北京市有關(guān)規(guī)定，甲、乙雙方在平等自愿的基礎(chǔ)上，經(jīng)友好協(xié)商一致，就甲方將其合法擁有的房屋出租給乙方使用，乙方承租使用甲方房屋事宜，訂立本合同。

　　Party A and B have reached an agreement through friendly consultation to conclude the following contract.

　　一、建物地址 / Location of the premises

　　甲方將其所有的位于北京市區(qū)的房屋及其附屬設(shè)施在良好狀態(tài)下出租給乙方使用。

　　2. 租金按月為壹期支付;第一期租金于年月日以前付清;以后每期租金于每月的日以前繳納，先付后住(若乙方以匯款形式支付租金，則以匯出日為支付日，匯費(fèi)由匯出方承擔(dān));甲方收到租金后予書(shū)面簽收。

　　Payment of rental will be one installment everymonth(s).

　　The first installment will be paid before(month)(day)(year).

　　Each successive installment will be paid by day of each month. Party B will pay the rental before using the premises and attached facilities (In case Party B pays the rental in the form of remittance, the date of remitting will be the day of payment and the remittance fee will be borne by the remitter.) 　　如乙方逾期支付租金超過(guò)七天，則每天以月租金的0.5%支付滯納金;如乙方逾期支付租金超過(guò)十天，則視為乙方自動(dòng)退租，構(gòu)成違約，甲方有權(quán)收回房屋，并追究乙方違約責(zé)任。

　　In case the rental is more than 7 working days overdue, Party B will pay 0.5 percent of monthly rental as overdue fine every day, if the rental be paid 10 days overdue, Party B will be deemed to have with drawn from the premises and breach the contract. In this situation, Party A has the right to take back the premises and take actions against party B’s breach.

　　五、押金 / Deposit

　　1. 為確保房屋及其附屬設(shè)施之安全與完好，及租賃期內(nèi)相關(guān)費(fèi)用之如期結(jié)算，乙方同意于年月日前支付給甲方押金元整，甲方在收到押金后予以書(shū)面簽收。

　　Guarantying the safety and good conditions of the premises and attached facilities and account of relevant fees are settled on schedule during the lease term, party B will payto party A as a deposit before(month)(day)(year). Party A will issue a written receipt after receiving the deposit.

　　2. 除合同另有約定外，甲方應(yīng)于租賃關(guān)系消除且乙方遷空、點(diǎn)清并付清所有應(yīng)付費(fèi)用后的`當(dāng)天將押金全額無(wú)息退還乙方。

　　Unless otherwise provided for by this contract, Party A will return full amount of the deposit without interest on the day when this contract expires and party B clears the premises and has paid all due rental and other expenses.

　　3. 因乙方違反本合同的規(guī)定而產(chǎn)生的違約金、損壞賠償金和其它相關(guān)費(fèi)用，甲方可在押金中抵扣，不足部分乙方必須在接到甲方付款通知后十日內(nèi)補(bǔ)足。

　　In case party B breaches this contract, party A has right to deduct the default fine, compensation for damage or any other expenses from the deposit . In case the deposit is not sufficient to cover such items, Party B should pay the insufficiency within ten days after receiving the written notice of payment from Party A.

　　4. 因甲方原因?qū)е乱曳綗o(wú)法在租賃期內(nèi)正常租用該物業(yè)，甲方應(yīng)立即全額無(wú)息退還押金予乙方，且乙方有權(quán)追究甲方的違約責(zé)任。

　　If Party B can’t normally use the apartment because of Party A , Party A should return the deposit to Party B at once. And, Party B has the right to ask for the compensation from Party A.

　　六、甲方義務(wù) / Obligations of Party A

　　1. 甲方須按時(shí)將房屋及附屬設(shè)施(詳見(jiàn)附件)交付乙方使用。

　　Party A will provide the premises and attached facilities (see the appendix of furniture list for detail) on schedule to Party B for using.

　　2. 房屋設(shè)施如因質(zhì)量原因、自然損耗、不可抗力或意外事件而受到損壞，甲方有修繕并承擔(dān)相關(guān)費(fèi)用的責(zé)任。如甲方未在兩周內(nèi)修復(fù)該損壞物，以致乙方無(wú)法正常使用房屋設(shè)施，乙方有權(quán)終止該合約，并要求退還押金。

　　In case the premise and attached facilities are damaged by quality problems, natural damages or accidents, Party A will be responsible to repair and pay the relevant expenses. If Party A can’t repair the damaged facilities in two weeks so that Party B can’t use the facilities normally, Party B has the right to terminate the contract and Party A must return the deposit.

　　3. 甲方應(yīng)確保出租的房屋享有出租的權(quán)利，如租賃期內(nèi)該房屋發(fā)生所有權(quán)全部或部分轉(zhuǎn)移、設(shè)定他項(xiàng)物權(quán)或其他影響乙方權(quán)益的事件，甲方應(yīng)保證所有權(quán)人、他項(xiàng)權(quán)利人或其他影響乙方權(quán)益的第三者能繼續(xù)遵守本合同所有條款，反之如乙方權(quán)益因此遭受損害，甲方應(yīng)負(fù)賠償責(zé)任。

　　4. 甲方應(yīng)為本合同辦理登記備案手續(xù)，如因未辦理相關(guān)登記手續(xù)致該合同無(wú)效或損害乙方租賃權(quán)利，應(yīng)由甲方負(fù)責(zé)賠償，且甲方應(yīng)承擔(dān)該合同相關(guān)的所有稅費(fèi)。

　　Party A must register this contract with the relevant government authority If not doing so resultingthat this contract is invalid or Party B’s right of leasing may be damaged , Party A should take the all responsibilities. Party A should also bear the all the relevant taxes.

　　七、乙方義務(wù)/ Obligations of Party B

　　1. 乙方應(yīng)按合同的規(guī)定按時(shí)支付租金及押金。

　　Party B will pay the rental and the deposit on time.

　　2. 乙方經(jīng)甲方同意，可在房屋內(nèi)添置設(shè)備。租賃期滿后，乙方將添置的設(shè)備搬走，并保證不影響房屋的完好及正常使用。

　　Party B may add new facilities with Party A’s approval. When this contract expires, Party B may take away the added facilities without changing the good conditions of the premises for normal use.

　　未經(jīng)甲方同意，乙方不得將承租的房屋轉(zhuǎn)租或分租，并愛(ài)護(hù)使用該房屋如因乙方過(guò)失或過(guò)錯(cuò)致使房屋及設(shè)施受損，乙方應(yīng)承擔(dān)賠償責(zé)任。

　　Party B will not transfer the lease of the premises or sublet it without Party A’s approval and should take good care of the premises. Otherwise, Party B will be responsible to compensate any damages of the premises and attached facilities caused by its fault and negligence.

　　4. 乙方應(yīng)按本合同規(guī)定合法使用該房屋，不得擅自改變使用性質(zhì)。乙方不得在該房屋內(nèi)存放危險(xiǎn)物品。否則，如該房屋及附屬設(shè)施因此受損，乙方應(yīng)承擔(dān)全部責(zé)任。

　　Party B will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous materials in it. Otherwise, Party B will be responsible for the damages caused by it .

　　5.乙方應(yīng)承擔(dān)租賃期內(nèi)的水、電、煤氣、電話費(fèi)、收視費(fèi)、一切因?qū)嶋H使用而產(chǎn)生的費(fèi)用，并按單如期繳納。

　　Party B will bear the cost of utilities such as telephone communications, water, electricity and gas on time during the lease term.

　　八、合同終止及解除的規(guī)定/ Termination and dissolution of the contract

　　1. 乙方在租賃期滿后如需續(xù)租，應(yīng)提前一個(gè)月通知甲方，由雙方另行協(xié)商續(xù)租事宜。在同等條件下乙方享有優(yōu)先續(xù)租權(quán)。

　　Within one month before the contract expires, Party B will notify Party A if it intends to extend the lease. In this situation, two parties will discuss matters over the extension.Under the same terms Party B has the priority to lease the premises.

　　2. 租賃期滿后，乙方應(yīng)在日內(nèi)將房屋交還甲方;任何滯留物，如未取得甲方諒解，均視為放棄，任憑甲方處置，乙方?jīng)Q無(wú)異議。

　　When the lease term expires, Party B will return the premises and attached facilities to Party A withindays. Any belongings left in it without Party A’s previous understanding will be deemed to be abandoned by Party B. In this situation, Party A has the right to dispose of it and Party A will raise no objection.

　　本合同一經(jīng)雙方簽字后立即生效;未經(jīng)雙方同意，不得任意終止，如有未盡事宜，甲、乙雙方可另行協(xié)商。

　　This contract will be effective after being signed by both parties. Any party has no right to terminate this contract without another party’s agreement. Anything not covered in this contract will be discussed separately by both parties.

　　九、違約及處理/ Breach of the contract

　　1. 甲、乙雙方任何一方在未征得對(duì)方諒解的情況下，不履行本合同規(guī)定條款，導(dǎo)致本合同中途終止，則視為該方違約，雙方同意違約金為元整，若違約金不足彌補(bǔ)無(wú)過(guò)錯(cuò)方之損失，則違約方還需就不足部分支付賠償金。

　　During the lease term, any party who fails to fulfill any article of this contract without the other party’s understanding will be deemed to breach the contract. Both parties agree that the default fine will be. In case the default fine is not sufficient to cover the loss suffered by the faultless party, the party in breach should pay additional compensation to the other party.

　　2. 若雙方在執(zhí)行本合同或與本合同有關(guān)的事情時(shí)發(fā)生爭(zhēng)議，應(yīng)首先友好協(xié)商;協(xié)商不成，可向有管轄權(quán)的人民法院提起訴訟。

　　Both parties will solve the disputes arising from execution of the contract or in connection with the contract through friendly consultation. In case the agreement cannot be reached, any party may summit the dispute to the court that has the jurisdiction over the matter.

　　十、其他 / Miscellaneous

　　1. 本合同附件是本合同的有效組成部分，與本合同具有同等法律效力。
